This End-User License Agreement ("EULA") is between you and Brae Applications, LLC, a Washington limited liability company that operates HomeTeams ("we," "us"). It covers your license to use the HomeTeams mobile application and related software (the "App").
This EULA works alongside our Terms of Service and Privacy Policy. If this EULA conflicts with the Terms of Service, the Terms of Service control.
1. License Grant
Subject to this EULA and the Terms of Service, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices you own or control, for your personal, non-commercial caregiving use.
2. Restrictions
You may not, except to the extent applicable law expressly permits:
- copy, modify, or create derivative works of the App;
- reverse engineer, decompile, or disassemble the App;
- rent, lease, sell, sublicense, or distribute the App;
- remove or alter any proprietary notices; or
- use the App in violation of the Terms of Service or any law.
3. Ownership
The App is licensed, not sold. We and our licensors retain all rights, title, and interest in the App, except as expressly granted in this EULA. Your content remains yours, as described in the Terms of Service.
4. Updates and Third-Party Components
We may update, change, or discontinue features of the App at any time. Some updates may be required to keep using the App.
The App may include open-source or third-party components that are licensed under their own terms. Those terms govern your use of those components.
If you downloaded the App from an app store, such as the Apple App Store or Google Play, the app store is not a party to this EULA and is not responsible for the App. You must also comply with the app store's terms. Section 9 contains additional terms for Apple App Store users.
5. Termination
This license lasts until you or we end it. You may end it by deleting your account and uninstalling the App. We may end it as described in the Terms of Service. When it ends, you must stop using the App. Sections 2, 3, 6, and 7 survive.
6. Disclaimers and Limitation of Liability
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, TO THE FULLEST EXTENT PERMITTED BY LAW. HomeTeams is not a healthcare provider, does not provide medical advice, and is not intended for use in emergencies.
The disclaimers and limitations of liability in the Terms of Service apply to the App as if set out here in full.
7. Governing Law and Disputes
This EULA is governed by the laws of the State of Washington. Any dispute is resolved under the governing law, arbitration, and class action waiver provisions of the Terms of Service.
8. Changes and Contact
We may update this EULA. If we make material changes, we will notify you in the App or by email, and continued use means you accept the updated EULA.

9. Additional Terms for Apple App Store Users
If you downloaded the App from the Apple App Store, these terms also apply. If they conflict with anything else in this EULA, they control for your use of the iOS App.
- Parties. This EULA is between you and us only, not Apple. We, not Apple, are solely responsible for the App and its content.
- Scope. Your license is limited to use on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, including through Family Sharing where applicable.
- Support. We are solely responsible for maintenance and support. Apple has no obligation to provide any.
- Warranty. If the App fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims or losses from a warranty failure are our responsibility.
- Product claims. We, not Apple, are responsible for any claims relating to the App or your use of it, including product liability claims, claims that the App fails to meet a legal or regulatory requirement, and consumer protection, privacy, or similar claims, including those relating to the App's use of HealthKit.
- Intellectual property. If a third party claims the App or your use of it infringes their intellectual property, we, not Apple, are solely responsible for investigating, defending, settling, and discharging that claim.
- Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Third-party terms. You must comply with applicable third-party agreements when using the App, such as your wireless carrier's data and messaging terms.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of this EULA. Once you accept it, Apple may enforce it against you.
Este Acuerdo de Licencia de Usuario Final ("EULA") se celebra entre usted y Brae Applications, LLC, una sociedad de responsabilidad limitada de Washington que opera HomeTeams ("nosotros"). Cubre su licencia para usar la aplicación móvil HomeTeams y el software relacionado (la "App").
Este EULA funciona junto con nuestros Términos del Servicio y nuestra Política de Privacidad. Si este EULA entra en conflicto con los Términos del Servicio, prevalecen los Términos del Servicio.
1. Concesión de licencia
Sujeto a este EULA y a los Términos del Servicio, le otorgamos una licencia limitada, personal, no exclusiva, intransferible y revocable para descargar, instalar y usar la App en dispositivos que usted posea o controle, para su uso personal y no comercial de cuidado.
2. Restricciones
Salvo en la medida en que la ley aplicable lo permita expresamente, usted no puede:
- copiar, modificar ni crear obras derivadas de la App;
- aplicar ingeniería inversa, descompilar ni desensamblar la App;
- alquilar, arrendar, vender, sublicenciar ni distribuir la App;
- eliminar ni alterar ningún aviso de propiedad; ni
- usar la App en violación de los Términos del Servicio o de cualquier ley.
3. Propiedad
La App se otorga bajo licencia, no se vende. Nosotros y nuestros licenciantes conservamos todos los derechos, títulos e intereses sobre la App, salvo lo expresamente otorgado en este EULA. Su contenido sigue siendo suyo, como se describe en los Términos del Servicio.
4. Actualizaciones y componentes de terceros
Podemos actualizar, cambiar o descontinuar funciones de la App en cualquier momento. Algunas actualizaciones pueden ser necesarias para seguir usando la App.
La App puede incluir componentes de código abierto o de terceros que se licencian bajo sus propios términos. Esos términos rigen su uso de dichos componentes.

5. Terminación
Esta licencia dura hasta que usted o nosotros la terminemos. Usted puede terminarla eliminando su cuenta y desinstalando la App. Nosotros podemos terminarla según se describe en los Términos del Servicio. Cuando termine, debe dejar de usar la App. Las Secciones 2, 3, 6 y 7 subsisten.

7. Ley aplicable y disputas
Este EULA se rige por las leyes del Estado de Washington. Cualquier disputa se resuelve conforme a las disposiciones de ley aplicable, arbitraje y renuncia a acciones colectivas de los Términos del Servicio.
8. Cambios y contacto
Podemos actualizar este EULA. Si hacemos cambios importantes, se lo notificaremos en la App o por correo electrónico, y el uso continuado significa que acepta el EULA actualizado.

- Términos de terceros. Debe cumplir los acuerdos de terceros aplicables al usar la App, como los términos de datos y mensajería de su operador inalámbrico.
- Tercero beneficiario. Apple y sus subsidiarias son terceros beneficiarios de este EULA. Una vez que usted lo acepte, Apple podrá hacerlo valer frente a usted.
